New laws affecting drivers on Maryland roads are now in place as of October 1, 2014. These new laws will affect all drivers, but most notably DUI offenders.
First, penalties increased for those drivers who have a third or subsequent violation of either (1) driving while impaired by alcohol or (2) driving while so far impaired by any drugs, and/or drugs and alcohol, that the person cannot drive safely. The penalties have increased from a maximum of one year of imprisonment and/or a fine of up to $500, to now a maximum of three years of imprisonment and/or a fine of up to $3,000. If either of these offenses is committed while transporting a minor, the maximum penalty for a third or subsequent offense has now increased from a maximum of one year imprisonment and/or a fine of up to $2,000 to a maximum of four years imprisonment and/or a fine of up to $4,000.
More DUI reform continued with those drivers who transport minors. An individual who is convicted of transporting a minor under the age of 16 while driving under the influence of alcohol, under the influence of alcohol per se, or while impaired by alcohol, will now be required to participate in the Ignition Interlock System Program (IISP).
